This Acceptable Use Policy ("AUP") governs the use of the WinMail email delivery platform (the "Service"). It exists to keep deliverability high and to protect recipients, our sending infrastructure and the sending reputation shared by all customers. By using the Service you agree to this AUP. We may update it from time to time; continued use means acceptance of the current version.
1. Consent is mandatory
You may only send email to recipients who have given you clear, verifiable, opt-in consent to receive it, or with whom you have a genuine, existing business relationship that legally permits the message.
You must be able to prove, on request, when and how each recipient opted in (for example date, source and IP of the sign-up).
2. Prohibited recipient sources
The following lists are strictly forbidden and will lead to immediate suspension:
- Purchased, rented, leased or otherwise acquired email lists.
- Scraped, harvested or automatically generated addresses.
- Addresses obtained from a third party without the recipient's consent.
- Lists where consent cannot be demonstrated.
3. Prohibited content and behaviour
You must not use the Service to send:
- Unsolicited bulk email (spam) of any kind.
- Phishing, spoofing, malware, or deceptive "From", "Reply-To" or subject lines.
- Content that is illegal, fraudulent, defamatory, or infringes intellectual property.
- Content promoting hate, violence, or the sexual exploitation of minors.
4. Message requirements
Every message you send through WinMail must:
- Accurately identify you as the sender in the "From" and "Reply-To" fields.
- Include a clear, functioning unsubscribe mechanism where required by law.
- Honour every unsubscribe or opt-out request promptly (within the legally required period).
- Include a valid postal address of the sender where required (e.g. CAN-SPAM).
- Comply with GDPR, the ePrivacy rules, CAN-SPAM and all other applicable laws.
5. Deliverability, bounces and complaints
You must maintain healthy sending practices. Excessive hard bounces, spam complaints or spam-trap hits may trigger automatic rate limiting, suspension or termination.
You must not send to addresses on your suppression list, and you must not attempt to bypass suppression, bounce or complaint handling.
6. Security and fair use
Keep your SMTP credentials and API keys secret. You are responsible for all traffic sent through your account.
Do not attempt to overload, probe, reverse-engineer or gain unauthorised access to the Service or its infrastructure.
7. Enforcement
We may investigate suspected violations and may suspend or terminate accounts, throttle sending, or remove content without prior notice where necessary to protect the Service and its users.
We reserve the right to report illegal activity to the competent authorities.
