These Terms of Service ("Terms") govern your access to and use of the WinMail platform, operated at winmail.gr by Mitsidis Stavros - Mitsidou Xanthi Co. (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
WinMail is a SaaS transactional email delivery platform providing SMTP relay, a REST API, domain authentication (DKIM/SPF), webhooks and delivery analytics.
2. Accounts
You must provide accurate information and are responsible for maintaining the confidentiality of your credentials and API keys, and for all activity under your account.
You must be at least 18 years old and legally able to enter into these Terms.
3. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations of the AUP are violations of these Terms.
4. Fees and billing
Paid plans are billed according to the pricing agreed at sign-up. Fees are exclusive of applicable taxes (e.g. VAT) unless stated otherwise. Non-payment may result in suspension.
5. Availability
We work to keep the Service reliable but do not guarantee uninterrupted or error-free operation. Parts of the Service depend on third-party cloud infrastructure providers.
6. Suspension and termination
We may suspend or terminate your access if you breach these Terms or the AUP, if required by law, or to protect the Service, other customers or third parties. You may stop using the Service at any time.
7. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, WinMail shall not be liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill arising from the use of the Service.
9. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
10. Governing law
These Terms are governed by the laws of Greece, and any disputes are subject to the competent courts of Greece, without prejudice to mandatory consumer protection rules.
